Terms of Service

These Terms of Service ("Terms") are an agreement between you and VoteStacks ("we", "us", or "our") and govern your access to and use of the VoteStacks website, mobile applications, and related services (collectively, the "Service"). VoteStacks is an independent, hobby project.

By accessing or using the Service, creating an account, or casting a vote, you agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Community Guidelines, each of which is incorporated by reference. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian.

By using the Service, you represent and warrant that you meet these requirements, that you are not barred from receiving the Service under applicable law, and that any information you provide is accurate and current.

You may need to register for an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You agree to:

• Provide accurate, complete registration information and keep it up to date.
• Keep your login credentials secure and not share them with others.
• Notify us promptly of any unauthorized use of your account.

We may suspend or terminate accounts that violate these Terms, are inactive for an extended period, or are used in a manner that creates risk or legal exposure for us or others.

The Service lets you create polls, cast votes, comment, and share content ("User Content"). You retain ownership of your User Content.

By submitting User Content, you grant VoteStacks a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify (for formatting), publicly display, and distribute that content solely to operate, promote, and improve the Service.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms, the Acceptable Use Policy, or any law or third-party right.

Your use of the Service must comply with our Acceptable Use Policy and Community Guidelines. Among other things, you may not use the Service to post unlawful, infringing, harassing, or deceptive content, to manipulate votes, or to interfere with the operation of the Service.

We may remove content or restrict access to accounts that violate these rules, with or without notice.

The Service, including its software, design, text, graphics, and logos (excluding User Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms.

You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from any part of the Service except as expressly permitted.

The Service may offer optional paid features or subscriptions. Pricing, billing cycles, and features will be described at the point of purchase. Unless required by law or stated otherwise, payments are non-refundable.

We may change prices or the features included in paid plans on a prospective basis, with reasonable notice for active subscribers.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms, if required by law, or to protect the Service or other users.

Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Polls and their results reflect the opinions of participants and are not verified, scientific, or representative surveys. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOTESTACKS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE.

The Service is offered free of charge as a hobby project, and our total liability for any claim relating to the Service will not exceed one hundred US dollars (USD $100).

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting the updated Terms with a new effective date or notifying you in the Service. Your continued use after changes take effect constitutes acceptance.
